1. Who we are & how these Terms work
Shanty Spirit Ltd (“Shanty Spirit”, “we”, “us”, “our”), a company registered in England & Wales (No. 10751907), operates this website and online store (the “Services”). Our store is hosted and powered by Shopify. By using the Services you agree to these Terms and to our Privacy Policy and Returns & Refunds Policy.
2. Age restrictions (alcohol sales)
You must be of legal drinking age in your country to purchase from us. We operate age-gating and may require age verification at checkout and/or on delivery (Challenge 25 in the UK). Couriers may request valid photo ID and may refuse delivery if satisfactory ID is not provided. We do not deliver alcohol to minors or leave alcohol unattended.
3. Access, account & information you provide
You agree that information you provide (e.g., email, billing, shipping, payment details) is accurate and kept up to date. You’re responsible for keeping login credentials secure and for all activity under your account.
4. Products, descriptions & availability
We aim to describe products accurately; actual colours/appearance may vary by device. We may change or discontinue products, limits and availability at any time. Products are for personal use only and not for resale or export.
5. Ordering & contract formation
Your order is an offer to buy. We accept only when we send an order-confirmation email. If we cannot accept or must cancel an order (e.g., stock, pricing error, regulatory, age verification failure, delivery restrictions), we will notify you and refund any amounts paid.
6. Pricing, VAT, promotions & billing
Unless stated otherwise, prices shown to UK consumers are inclusive of VAT. Delivery, duty, and other charges (if any) are shown at checkout. Promotions may be subject to additional terms; if there is a conflict, promotion terms prevail. You authorise us (and Shopify’s payments processors) to take payment using your chosen method.
7. Shipping, delivery & risk
We ship to the destinations shown at checkout. Delivery times are estimates only. For UK consumer orders, risk in the goods passes on delivery to you (or a person you nominate who is of legal drinking age), not when we hand the parcel to the carrier. Couriers may refuse delivery if age cannot be verified or a safe delivery cannot be made. Title passes on full payment. We do not leave alcohol in safespaces or with minors.
8. Returns, exchanges & your right to cancel
Please see our Returns & Refunds Policy. In the UK, consumers generally have 14 days from receipt to cancel (cooling-off). Bottles must be unopened, sealed and in original packaging. If you cancel under cooling-off, we refund the product price and the standard outbound delivery charge; you pay return postage unless the item is faulty. For health protection, opened/unsealed bottles cannot be returned unless faulty. This does not affect your legal rights.
9. Events, tastings & experiences (if applicable)
Tickets/experience bookings may have specific terms (date changes, ID checks, conduct, photography). We reserve the right to refuse entry or service to intoxicated or underage guests.
10. Intellectual property
All content on the Services (including trademarks, logos, text, images, video and layout) is owned by us or our licensors. You may use the Services for personal, non-commercial purposes only. No licence is granted except as required to use the Services.
11. Feedback & reviews
If you submit reviews, photos, ideas or other content (“Feedback”) you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce and display that Feedback for our business and marketing. Do not submit unlawful, misleading or infringing content. We may moderate or remove content at our discretion.
12. Third-party tools & links
We may provide access to third-party tools and links (including embedded functionality). Use is at your own discretion and governed by those third parties’ terms and privacy policies. We are not responsible for third-party content, products or services.
13. Our relationship with Shopify
Sales on this store are made by Shanty Spirit Ltd to you. Shopify provides the ecommerce platform but is not a party to your sale and is not responsible for our products, fulfilment or customer service.
14. Limits on our responsibility (your statutory rights remain)
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
We do not accept responsibility for: (a) loss not caused by our breach or negligence; (b) losses that were not reasonably foreseeable to both of us when the contract was formed; (c) business losses and/or loss of profit, revenue, or data for non-consumer purchasers. Your statutory rights (including under the Consumer Rights Act 2015) are not affected.
15. Suspension or termination
We may suspend or terminate your access if you breach these Terms, if we suspect fraud/abuse, or for regulatory reasons. You remain responsible for charges incurred up to termination.
16. Governing law & jurisdiction
These Terms and any dispute or claim (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction; if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
17. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted here with the “Last updated” date. For material changes, we will provide notice as required by law. Your continued use of the Services after changes take effect constitutes acceptance.
